Покотиловъ, въ теченіе 1906 и 1907 г.г. произвелъ, — надлежаще къ тому уполномоченный, — обмѣнъ нотъ съ Представителями: Соединенныхъ Штатовъ (15 Іюня 1906 г.), Бельгіи (29 Сентября и 2 Октября 1906 г.), Италіи (3 Октября 1906 г.), Великобританіи (16 и 17 Октября 1906 г.), Франціи (17 Ноября 1906 г.) и Германіи (19 Января 1907 г.) касательно взаимной охраны въ Китаѣ правъ промышленной собствен ности. Вслѣдствіе сего, Министръ Юстиціи, 12 Октября 1913 года, предложилъ Правительствующему Сенату означенныя ноты съ переводами на русскій языкъ, для распубликованія. Note adressée par le Ministre des Etats-Unis à Pékin au Ministre de Russie en date du 15/28 Juin 1906. The Government of the United States being desirous of reaching an understanding with the Government of Russia for the reciprocal protection against infringement in China by citizens and subjects of our respective nations of trade marks duly registered in the United States and Russia, I am authorized by the Secretary of State of the United States to inform you that the American Consular Courts in China afford protection against infringement in China by american citizens of trade marks, the property of Russian subjects, which have been duly registered in the United States. I beg that you will kindly inform me, whether like protection will be - given to american citizens in the Consular Courts of Russia in China against the infringement by russian subjects of their trade marks duly registered in Russia. J'ai l'honneur de Vous accuser réception de la note en date d'aujourd'hui, par laquelle Vous avez bien voulu me faire savoir que le Gouvernement des Etats-Unis étant désireux d'arriver à un arrangement avec le Gouvernement Imperial de Russie concernant la protection en Chine des marques de commerce dûment enregistrées en Russie et aux Etats-Unis, Vous avez été autorisé de déclarer que les cours consulaires americaines en Chine étaient compétentes dans toutes les matières relatives à la contrefaçon par les citoyens et ressortissants américains des marques de commerce, propriété des sujets russes, dûment enregistrées aux Etats-Unis. Ayant été autorisé à cet effet par mon Gouvernement, j'ai l'honneur de Vous déclarer, de mon côté, que le Gouvernement Impérial est également prêt à assurer en Chine, par l'entremise des cours consulaires russes, la protection des marques de commerce, propriété des citoyens et ressortissants américains, dûment enregistrées en Russie qui pourraient être l'objet de contrefaçon de la part des sujets russes. Je crois cependant devoir observer, que la contrefaçon des marques de commerce n'étant pas considérée par les Statuts américains comme une offense criminelle, les citoyens et ressortissants américains, lésés dans leurs droits, ne pourront réclamer, pour des raisons de réciprocité, par devant les tribunaux russes, que l'indemnisation des pertes par eux encourues.
