PREFACE. THE subject and purpose of this small work speak for themselves. The author's endeavour, to the best of his ability, has been to connect together, and to explain, in both languages, as clearly as the confused nature of the topic, and the limits of the book permit, the double system of jurisprudence which supports this International Convention-a task of no little difficulty, when one considers the extreme verbosity and prolixity which encircle and obscure, especially in England, the wisdom of the law. Touching the Convention itself, little in support of its merits need be spoken. The magnitude of its utility luminously appears. Fostering every better and gentler feeling-keeping alive the bright, yet benignant flame of intellectual emulation between the two greatest nations the world has ever seen-this Convention holds in its keep and power the fair cause of human enlightenment, and the consequent preservation of the incalculable blessings PRÉFACE. L'auteur a fait de son mieux pour rendre dans les deux langues, et expliquer aussi clairement que le permettaient la nature d'un sujet aussi embrouillé et les limites de cet ouvrage, le double système de jurisprudence sur lequel est basée cette Convention Internationale; et si l'on considère la verbosité et la prolixité interminables dans lesquelles tourne et se cache, surtout en Angleterre, la sagesse de la loi, on admettra que la tâche était peu facile. Quant à la Convention elle-même, il n'y a rien de plus à en dire: la grandeur de son utilité parait avec éclat. Time and experience will no doubt bring into view many valuable improvements to add to the boon. Some of these have occurred to the author in the course of his present labours; such, for instance, as extending and enlarging the protection granted to dramatic translations-establishing an English copyright in painting, which, strange to say, does not now exist—and giving to the English common law courts and judges the same equitable jurisdiction regarding injunctions in cases of literary and artistic piracy as they have just obtained in relation to patent infringeThese ameliorations, once their necessity becomes evident, will doubtless be speedily realised, now that the public mind of France, mighty in the activity of its intelligence, takes interest about them; and that our own great champions in behalf of literature and scienceBrougham, Bulwer, and others of note-continue members of Parliament, and stanch advocates for the universality of knowledge. Thanks to them, these intellectual reforms have already steadily and surely gone on, bringing fruits which will remain sensibly to the taste in the far-distant time to come, when past warlike and political glory will be but too often a thing of mere boastful or doubtful recollection. The hope is that all other countries will take example from la conservation des bienfaits innombrables de la paix. Ces améliorations, dont l'urgente nécessité ne peut manquer d'être sentie, seront sans doute bientôt realisées maintenant que l'esprit public en France, si puissant par la force de son intelligence, est préoccupé en leur faveur, et que nos grands champions nationaux de la littérature et de la science, tels que Brougham, Bulwer, et d'autres hommes de haute portée, restent dans le Parlement où ils se montrent les fermes défenseurs de la propagation des lumières.
