Meffieurs d'Appleterre, and de la Faille, Majors-General; and all other Superior Officers that are in the City; as alfo all the Officers of Regiments which are not part of the Garrifon, who were fhut up in the City, fhall go out with the Garrison, with their Domefticks, Horfes and Equipages; as fhall alfo the Domefticks, Horfes and Equipages of the General, and particular Officers employ'd in the Army, or elsewhere, which are in the Town; and that particular Pafports be granted to the General-Officers to retire to any part of Spain, if they require them. Granted.

X. That fuch of the Garrifon as have been taken Prifoners during the Siege, the Commanding Officers and Soldiers of the Forts of the Haine, Nimi, Moulin aux Bois, and all that have been taken in the other Works; as alfo fuch as endeavoured to get into the Town fince it was invefted, fhall be returned on either fide. Granted, For those who were taken on either fide during the Siege; but excepting fuch, who would have thrown themselves into the Place.

XI. That fuch of the faid Prifoners as are in the Army of the High-Allies, fhall be sent back into the 'Town, before the Garrifon marches out; and that fuch as have been fent to other Places, fhall be returned to Namur, within Ten Days after figning this Capitulation; and fuch of the Troops of the High-Allies, as are in the Town, fhall be immediately returned to the Army. Granted.

XII. That Ten covered Waggons be provided by the High-Allies, which fhall be fent into the City the Evening before the Garrifon marches out, and fhall attend the Garrifon to Namur, without being fearch'd by the Allies, under any Pretext whatfoever. Granted, That they fhall have Four.

XIII. That no Perfon employed in the Service of the Two Crowns, nor their Equipages, Papers, or Effects, fhall be feized on any Pretence whatfoever; and that fufficient Carriages be granted them, at the Charge of the Allies, for the Conveyance of their Families, Effects, Papers and Domesticks, by the nigheft Way to Namur. Granted, excepting Deferters, and the Heftages are to be responsible for the

XIV. That no Demand be made on the Befieged for the Houses burnt or beaten down in the Suburbs, or any other Damage done during the Siege. Granted, provided this no way refpect: Provisions, and other Debts which have been contracted.

XV. That Monfieur de la Neuville, Commiffary of War, the Sieur de Lannoy, Treafurer of the Garrifon, and the Sieur Gaudry, Commiffary of the Provifions, fhall ftay to regulate the Accompts of the Debts, lawfully contracted during the Siege, and other Debts which are paid by the Treasurers of France. Answered by the fifth Article.

XVI. That Monfieur de la Forge, Commiffary and Receiver-General of the Finances, fhall ftay to regulate the Debts, in Relation to Spain. Anfwer'd by the precedent Article.

XVII. That no other Perfon of the Garrifon, without Distinction, that ferve the Two Kings, in a Civil or Military Capacity, fhall be arrested or molested on any Reafon or Pretext whatfoever, for the Debts of the Two Crowns; but that the faid Garrifon, and all Officers, Military and Civil, march out fafely, and be faithfully conducted to Namur and Maubeuge, by the nigheft Road, according to what hath been faid before, with their Papers, Effects, Baggage and Equipage. Granted, as before explained.

XVIII. That the High-Allies fhall not take any Soldier, Trooper, or Dragoon out of their Ranks, either as they pafs out of the Town, or on their March, on any Pretence whatfoever. Granted, excepting Deferters, and no Violence shall be used on either fide; but it shall be free for them to lift themselves as they pleafe.

XIX. That the Garrifon fhall be permitted to fupply themselves out of the Magazines of the Town, with the neceffary Provifions for the Subfiftance of the Officers, Soldiers, Troopers, and. Dragoons for Five Days after their March out of the City. Granted, That those who go to Namur hall have Provifions for Five Days, and those who march to Maubeuge, for Two.

XX. That the Gentlemen, Aids de Camp, Commiffaries, and all other Officers of War, State, Policy, or Finances of his Electoral Highness of Ba varia, and the Domesticks, with the Effects, Papers, Moveables, Horfes and Equipages which his faid Electoral Highness hath in this City; as alfo the Officers and Domefticks belonging to his Electoral Highness of Cologne, that are in this City, fhall go out with their Effects, with Freedom and Safety, and Guards; Waggons, and Pafports fhall be granted them, as they fhall have occafion.

Granted.

XXI. That all the Wives, Children and Families of Minifters, Generals, Officers and Soldiers; as alfo of all other Perfons employed in the Service of the Two Crowns, and of his Electoral Highness of Bavaria, of whatfoever Quality or Character they be, may retire with their Effects, Moveables and Cloaths within Six Months, to any other City belonging to the Two Crowns, as they fhall think convenient; and that Carriages, Pafs-ports and Guards for their Security be granted them, as they fhall have occafion. Granted, for Three Months, and that the Carriages be provided at their own Charge.

XXII. That all the Civil Officers, who have any Truft or Employment in the Province, and all the Inhabitants of the City of Mons, may be permitted to retire within Six Months to any of the Territories in Subjection to the Two Crowns, with their Families, Effects, Money, Papers, Moveables and Merchandizes; and that they fhall be furnished with Neceffaries by the High-Allies for their march, as they fhall require them. Granted, at their Expence, as before.

"When the Gate is deliver'd up,all Magazines of "Provifion and Ammunition fhall be faithfully difcovered to Commiffaries appointed for that "Purpose, without Exception; and Care shall be "taken that the faid Ammunition and Provision "fhall not be wasted or imbezzled in the mean ❝ time.

Lastly, Inftead of what was granted by the fifth Article, it is agreed on both Sides, That Monfieur de Brouchhoven, Intendant of the Finances; Monfieur de la Forge, Receiver-General of the Finances;

and

and Don Antonio de Soletto, Brigadier of the Troops of Spain, fhall remain as Hoftages for the Payment of the Debts of the Garrifon, and other juft De mands of the City, and the Province of Hainault, at the Charge of the Crown of Spain; and that the Count de Bergeyck fhall be refponfible for, and fatisfie all his own Engagements, and those of Monfieur Brouchhoven, which regard the Town of Ghent, the Country of Waes, and that Neighbourhood, within the Term of Three Months; in default of which, he fhall render himself to the City of Ghent, within Ten Days after he fhall be required fo to do by the High-Allies.

Concluded and agreed to on both Sides, at the Camp before Mons the 20th of October, 1709.

Aving Three Months ago delivered to your

Imperial Majefty, a Letter, which Her Majefty of Great Britain, my moft Gracious Queen and Miftrefs, writ to your Imperial Majefty, concerning the Reformed Inhabitants of Silefia; I 'tranfmitted to Her Majefty. the Answer your Imperial Majefty was graciously pleased to order to be communicated to me on that Subject, viz. That your Majefty would immediately give Orders to infpect, and examine the Rights about Religion, which the faid Reformed Silefians were to enjoy, and thereupon grant them their juft

Privileges, as the reft of your Subjects enjoyed, and likewife that Your Imperial Majefty would not be wanting to have a due regard to the Interceffion of Her Majefty of Great Britain, in their C Behalf. The Queen received this Declaration of your Imperial Majefty, with a particular Satisfaction, feeing thereby, how great a Value your Imperial Majefty put upon her friendly Interceition, and had been hourly expecting to hear that her good Offices have procured Relief to the poor diftreffed Silefians of the Reformed Religion. But being fince informed, that the prefling Inftances of 6 the faid Reformed, have not been bleffed with the leaft Satisfaction; that nothing has been hitherto tranfacted, that may tend to their Eafe and Comfort: and that no Orders have been iffued out for redreffing their Grievances in point of Religion: Her Majefty, the Queen, has therefore commanded me, to renew my most earneft Inftances with your Imperial Majefty, that your Imperial Majefty would be pleafed to give immediate Orders, that the Reformed in Silefia, may forthwith withour delay, be reftored to the free Poffeffion of thofe Rights and Privileges they enjoy'd before, and after the Treaty of Weftphalia, in which their faid Fights were allowed in a full and ample manner; and that they may be ufed, in all, and every refpect, as the Lutherans, and enjoy with them the faid Rights and Privileges.

'Her Majefty of Great Britain, having very exactly examined the Claims of the Reformed Silefians, and being fatisfy'd with the Juftice thereof, fhe cannot but be furpriz'd, that a further Delay 6 fhould be used in a matter which is as clear as the Sun, and contained not only in the Treaty of of nabrugh, but alfo in the Receffes, for the Execution of the fame, which enfued thereupon. By the faid Treaty of Ofnabrugh, and namely, the 7th Article, it is exprefly ftipulated, That thofe of the Confeilion of Augsburgh, fhall enjoy all the Rights and Privileges belonging to them in which expreffion the Reformed are neceffarily and undeniably comprehended: Furthermore, when in the faid Treaty mention is made of the Lutheran 'Princes in Silefia, who are allowed to enjoy the
