of fuch Loaf, or any other Mark as fhall be Ap pointed by the faid Court, &c. who fhall have Power to Direct in what Manner each Sort of Bread fhall be Marked, for knowing the Baker or Maker, Price, Weight, and Sott thereof, and may make any other Rules for the better Regulating the Mystery of Baking Bread, &c. And any Bakers not obferving the Affize to be Afcertained by this A&t, or Selling any Bread wanting the due Weight, or not Marked, or Breaking the Orders to be made, &c. being thereof Convicted, by Confeffion, or by Oath of one or more Witneffes, fhall, for every fuch Offence, forfeit the Sum of 40. to be Levied by Diftrefs, and the Forfeitures fhall be given to the Informer.

The Convictions made upon this A&t, fhall be certified to the next General Quarter Seffions of the Peace for the County, &c. and there kept upon Record by p. 256. the Clerks of the Peace, to be feen without Fee.

No Perfon fhall be Convicted for the before-mentioned Offences, unless the Profecution be Commen-* ced within Three Days next after the Offence committed.

Any Perfon aggrieved may Appeal to the next Quar ter-Seffions for the Place where fuch Conviction fhall: be made, where the fame fhall be finally determined; and if he fhall not make good his Appeal, or Profecute with Effect, the Court fhall Award fuch Cofts as they think fit to the Informer, and Commit the Offender to Goal till he pay the faid Cofts and Pe-> nalty: But if the Appellant fhall make good his Appeal, the like Cofts fhall be Awarded for the Appellant against fuch Informer.

Any Baker putting into any Bread, any Mixture of other Grain than what fhall be Appointed by the any Affize fettled in the Place where fuch Bread fhall be fold, fhall, for every fuch Offence, forfeit 20 s. And any Mayor, &c. omitting the Performance of his Duty, fhall forfeit 20 s.

The Lord Mayor, and Aldermen, &c. may, in the Day-time, enter into any Houfe, Shop, . belonging to any Baker, or Seller of Bread, there to Search for, View, Weigh, and Try the Bread of fuch Perfon; and if any Bread there fhall be found wanting either in the Goodness, or Deficient in Baking, or Working, or p. 257. Wanting in the due Weight, or not truly Marked, according to Directions of this A&t, or fhall be of any other Sort than fhall be allowed, in every fuch Cafe, the Lord-Mayor, &c. may Seize and Take the faid Bread, and caufe the fame to be forthwith given to the Poor of the Parish where the Seizure fhall be made; and if. fuch

fuch Baker, &c. fhall not permit fuch Search or Seizure to be made, &c. he fhall forfeit for every such Offence 40 s. to the Informer, to be Recovered in the fummary manner herein before-mentioned.

Any Action or Suit Commenced against any Mayor, &c. for doing any thing in purfuance of this Act, the Defendant may Plead the General Iffue, and give the fpecial Matter in Evidence; and if the Plaintiff be Nonfuited, &c. the Defendant fhall have double Cofts.

This A&t fhall not extend to prejudice any Right or Custom of the City of London, nor of the Lords of any Leet, to Set, Enquire, and Punish the Breach of Affize of Bread, within the Leets or Views of Frank-pledge, nor of the Clerks of the Market.

No Perfon Punished by this A&t, fhall, for the fame Offence, be Profecuted by any other Law.

All Juftices of Peace, Conftables, &c. are to fee the Acts 22 Car. 2. and 22 & 23 Car. 2. put in due Execution; and all Juftices of Affize, and Juftices of Peace, are, in their Charges at the Affizes or Seffions, to Enforce and Prefs the Execution of the faid Laws, and to use all Legal Methods to make the faid Laws, and this present A&, to be effectually Practifed and Obferved.

This A&t fhall not extend to prejudice the Right or Custom of the Two Universities of Oxford and Cambridge, or their Clerks of the Market there.

This A&t fhall continue for Three Years, and from thence to the End of the next Seffion of Parliament, and no longer.

An Abstract of the Act for the Encouragement of Learning, by Vefting the Copies of Printed Books, in the Authors or Purchafers of fuch Copies, during the times therein mentioned.

. 261. Naffed, That after 10 April, 1710. the Author of any Book already Printed, who hath not Transferred the Copy of fuch Book,&c. or the Bookfeller, &c. who hath Purchafed the Copy of any Book, in order to Print or Reprint the fame, fhall have the fole Right of Printing fuch Book for the Term of 21 Years, to Commence from the said 10 April, 1710, and no longer, and the Author of any Book not already Printed, and

his Affigns, fhall have the fole Liberty of Printing and Reprinting fuch Book, for the Term of 14 Years, to Commence from the Day of the firft Publishing the fame, and no longer; and if any other Perfon after 10 April, 1710. within the times limited by this A&, fhall Print, Reprint, &c. any fuch Book, without the Confent of the Proprietor thereof in Writing, Signed in the presence of two Witneffes, or knowing it to be fo printed, fhall Sell, Publifh, &c. without such Confent, then fuch Offender fhall Forfeit fuch Books to the Proprietors of the Copy, who fhall Damask and make wafte Paper of them, and alfo One Peny for every Sheet found in his Cuftody, either Printed or Printing, Published or Expofed to Sale, one Moiety to the Queen, the other to the Perfon fuing for the fame, Recoverable in any of her Majefties Courts of Record at Westminster, &c.

Nothing in this A&t fhall extend to fubject any Bookfeller, Printer, &c. to the Forfeitures of Penalties for Printing or Reprinting of any Books, unless the Title to the Copy of fuch Book or Books hereafter Published, fhall, before fuch Publication be Entred in the Register-Book of the Company of Stationers, which fhall be kept at the Hall of the faid Company, and unless the Confent of the Proprietors be alfo Entred, for which Entries Six Pence fhall be paid, and no more'; which Regifter-Book may be Reforted to, and in- p. 263. fpected by any Bookfeller, &c. without Fee or Reward; and the Clerk of the faid Company fhall give, when required, a Certificate of fuch Entry, for which he may take a Fee not exceeding 6 d.

If the Clerk fhall refufe or neglect to make fuch Entries, or give fuch Certificate, if thereunto required by the Author, &c. in the presence of Two Witnesses, then fuch Perfon, Notice being firft given of fuch Refufal in the Gazette, fhall have the like Benefit, as if fuch Entry and Certificate had been duly made, and the Clerk fhall Forfeit to the Proprietors 20 l.

If any Bookfeller or Printer, fhall, after 25 March, 1710. fet a Price upon, or Sell any Books at fuch a Price as fhall be conceived high and unreasonable, it fhall be Lawful for any Perfon to make complaint thereof to the Archbishop of Canterbury, the LordChancellor, the Bishop of London, the three Chief Juftices, the Vice-Chancellors of the Universities in England; the Lord Prefident of the Seffions, the LordJuftice-General, the Lord Chief Baron of the Exchequer, or the Rector of Edinburgh in Scotland, who fhall have full Power to call before them fuch Bookfeller,&c. and enquire of the reafon of the Dearnefs of the price

of fuch Book, and if upon Enquiry it be found, that the price is Inhaunced, or too high, then the faid Archbishop, &c. fhall have full Power to Redress the fame, and to Limit and Settle the Price of every fuch Printed Book, according to their Judgments; and the Bookfellers, &c. fhall pay all Charges that the Persons fo complaining fhall be at, by reafon of fuch Complaint; all which fhall be done by the Archbishop, &c. by Writing under their Hands and Seals, and thereof publick Notice fhall be given in the Gazette; and any Bookfeller, &c. that fhall after fuch Settlement made of the Price, fell any Books at higher Rates than what fhall be fo limited, fhall Forfeit 5 l. for every fuch Book fo Sold; one Moiety to the Queen, the other to the Perfon that shall fue for the fame.

Nine Copies of every Book upon the best Paper after 10 April, 1710. Printed or Reprinted with Additions, fhall by the Printer be delivered to the Warehouse, keeper of the Company of Stationers, at the Hall of the faid Company, before Publication, for the Ufe of the Royal Library; the Libraries of the Universities of Oxford and Cambridge; the Libraries of the 4 Univerfities in Scotland; the Library of Sion College in London; and the Library belonging to the Faculty of Advocates in Edinburgh, which Warehoufe-Keeper is, within 10 Days after Demand, to deliver the fame for the Ufe of the faid Libraries; and if any Bookfeller,&c. or the faid Warehoufe-Keeper, fhall not Obferve the Directions of this A&t therein, they fhall forfeit, hefides the Value of the Printed Copies, 51. for every Copy not fo delivered, with full Cofts.

The Penalties in this A&t in Scotland fhall be recoverable before the Court of Seffion there.

Nothing in this A&t fhall extend to prohibit the Importation, Vending or Selling of any Books in Greek, Latin, or any other Foreign Language, Printed be yond the Seas.

If any Action be brought against any Perfon, for doing any thing in purfuance of this Act, the Defendants may plead the General Iffue, and give the fpecial Matter in Evidence; and if a Verdict be given for the Defendant, &c. then the Defendant fhall have full Cofts, &c.

Nothing in this A&t fhall extend to prejudice or confirm any Right that the faid Universities, or any of them, or any Perfons have, or claim to have, to the Printing or Reprinting any Book or Copy already Prin ted, or hereafter to be Printed.

All A&tions, Suits, &c. for any Offence that fhall be committed against this A&t, fhall be Commenced

within Three Months next after fuch Offence committed.

After the Expiration of the Term of Fourteen Years, the fole Right of Printing or Difpofing of Copies fhall return to the Authors thereof, if living, for another Term of Fourteen Years.

An Act paffed in the Parliament of Ireland, in the Tear 1709, for Explaining and Amending an Act entituled, An Act to prevent the further Growth of Popery.

WE

Hereas an A&t made in this Kingdom, in the Second Year of the Reign of Her prefent Majefty, entituled, An Act to prevent the further Growth of Popery, has been eluded, by making of Settlements on Papifts, by granting Annuities for Lives, in Taile and Fee-Simple, and by perfecting collateral Securities, as Judgments, Recognizances, and Statutes defeazanc'd, for performing the Covenants in fuch Deeds of Annuity, and for answering private Trufts for the Benefit of fuch Papifts, under Colour and Pretence that Annuities being only perfonal, and not real Inheritances, are not comprehended within that Claufe of the faid Act, whereby Papifts are difabled from purchafing Lands and Tenements: For Remedy whereof, and for avoiding all Difputes that may arife thereon, be it enacted, by the Queen's most excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons in this prefent Parliament affembled, and by Authority of the fame, That no Papift, nor any other Perfon or Perfons in Truft for any Papift, fhall, from and after the Tenth Day of May, One thousand seven hundred and nine, be capable to take, have, or receive, any Annuity for Life, or Term of Years determinable on any Life or Lives, or for any greater or leffer Eftate, any ways chargeable on, or that may affect any Lands, Tenements, or Hereditaments; and that all Judgments, Statutes of the Staple or Merchant, Recognizances, and all and every other Security and Securities what foever, which, at any time hereafter, fhall be enter'd into, acknowledg'd, made, or perfected, to any Papift or Papifts, or to any other Perfon or Perfons in Truft for, and to the Ufe
