the Proprietors. Besides the goods under sequestration, whatever effects during the war may have been taken by force from the Persian Pilgrims and Subjects throughout the Ottoman Dominions, by the different Vizirs and Governors, on the representations of the Persian Government, Firmans shall be delivered up to the Agents of such persons, who, on giving lawful proofs of the authenticity of their claims, shall receive the required restitutions.

VI. On the demise of any Persian Subjects in the Ottoman Dominions, should the deceased have no lawful heir and executor present, the Officers of the Treasury (Beit ul Mal) shall, with the cognizance of the Law, register the property, and shall enter it upon the Records of the Courts of Judicature. For the period of one year the effects shall be lodged in a secure Place, until the lawful heir or administrator of the estate may arrive, when, according to the Register of the Courts of Judicature, the property shall be delivered up. The customary fees and the hire of the place for depositing the effects are to be paid, and should they be burnt or destroyed within the above stated period, no claims are to be advanced for the recovery of the property. If during the said period, the heir or the executor of the deceased does not arrive, the Officers of the Treasury, with the knowledge of the Agent of the Persian Government, shall sell the property and keep the amount in deposit.

VII. Agreeably to former Engagements, and for the purpose of adding fresh ties to the Alliance, a Minister shall be sent every three years to reside for that period at the respective Courts. The Subjects of the Two High Powers, who, during the War, may have deserted from either Country, in consideration of this happy Peace, shall suffer no punishment for the offence committed.

Final Article.-The Capitulations detailed in the Basis of the Treaty, and the Stipulations and different Articles which have been the result of the Conferences, shall be approved of by both Parties. No claims shall be advanced on account of plunder and losses, or any indemnification required for the expenses of the War, and the principle adhered to by both Governments shall be to overlook all past

occurrences.

According to established custom, the Ratifications of this Treaty shall be exchanged; and, from the signature of this Authentic Instrument, to the space of sixty days, Ambassadors of secondary rank shall meet each other on the Frontiers of the two Countries, and from thence proceed to the Courts of the respective States, for the purpose of delivering the Ratified Treaty. In this manner the Alliance has been renewed and confirmed, and the truest reconciliation has taken place from the date of this Treaty. No alterations shall be made in

the above Stipulations and Agreements, nor any measures hereafter pursued, in repugnance to the rights of friendship.

The Plenipotentiary of the Ottoman Government, in virtue of his Full Powers, has signed and sealed this Treaty on the 19th day of Zilkaade, in the year 1238, for which this Instrument in exact conformity thereto, has been delivered by the Plenipotentiary of His Persian Majesty, agreeably to his Full Powers.

ART. I. STANISLAUS SULISZOW suivra Osman à Constantinople en qualité d'Ambassadeur, en attendant qu'on y en envoye un Ordinaire. II. Un Huissier de la chambre du Grand Seigneur ira en diligence vers le Roy Sigismond pour escorter celuy qu'on y envoyera, avec toute sorte d'honneur.

III. Cet Ambassadeur sera d'une des plus nobles & des plus considérables Maisons de Pologne.

IV. Il sera accompagné d'un Secrétaire du Roy, qui à la façon de ceux des autres Princes Chréstiens demeurera à la Cour d'Osman. V. Les Polonnois défendront la Navigation sur le Boristhène aux Cosaques, & les chastieront rigoureusement s'ils font quelque tort aux Sujets de Sa Hautesse.

VI. Les Tartares ne feront aucunes courses dans la Pologne; & seront chassez par Osman du passage d'Okzakow.

VII. Ils récompenseront les dommages qu'ils feront aux Polonnois, & le Cham sera puni par le Sultan son propre Seigneur.

VIII. Toutes fois l'Edit n'aura pas lieu à l'égard des Sujets de l'un

& de l'autre Prince qui iront à la pesche, & à la chasse.

IX. Quand les Tartares marcheront sous les Enseignes des Turcs sur les Frontières des Païs appartenans à la Pologne, ils ne pourront faire leurs ravages au dedans.

X. L'un & l'autre Parti envoyeront leurs Commissaires, gens capables, pour régler les différends touchant les Limites des deux Estats.

XI. Le Roy de Pologne donnera les Appointemens accoustumez au Cham des Tartares, & les luy fera porter à Jassos, où le Cham les

envoyera quèrir, & sera tenu à la façon de ses ayeuls de porter les armes quand il sera appellé pour la République de Pologne.

XII. Il ne sera mis dans la Moldavie que des Palatins Chréstiens, exempts d'avarice, amateurs de Paix, & soigneux d'entretenir l'Alliance entre les deux Couronnes.

XIII. La Forteresse de Chocin sera mise és mains du Palatin de Moldavie.

XIV. Le Commerce & les passages seront libres entre les, Sujets d'Osman & de Sigismond.

XV. Les amis & ennemis seront censez communs.

XVI. Les anciens Traitez seront entretenus, & les nouveaux demeureront inviolables.

XVII. Quiconque entreprendra de violer aucun de ces Articles, sera estimé parjure, & chastié comme tel.

Tartar Emigrants, Families and Property.

ART. I. Tartaris illis, qui olim in Regno Poloniæ habitarunt, quos aliàs Lipce vocant, nunc verò ex eo discesserunt, & semet Illustrissimæ Portæ Ottomannicæ subjecerunt, Uxoresque & Liberos suos adhuc in Polonia reliquerunt, liberum sit, eas et eos cum bonis & rebus suis omnibus, sine ullo præpedimento avocare; In reliquorum autem, qui adhuc in Regno, ut & cum Uxoribus, Liberis, vel bonis et rebus, permanserunt, potestate esto, cum omnibus suis emigrare, aut illic subsistere.
