SUBSIDIARY AGREEMENT between the British and Sardinian Governments.-Signed at London, 3rd February, 1814. Articles of Agreement, entered into between Earl Bathurst, one of His Britannic Majesty's Principal Secretaries of State, and the Comte D'Aglié, His Sardinian Majesty's Chargé d'Affaires at the Court of London. THE British Government being desirous to second the loyal sentiments expressed by the Piedmontese Prisoners of War towards their Jawful Sovereign, His Sardinian Majesty, and the desire which they have manifested to bear Arms for the purpose of restoring him to his Dominions; and being at the same time anxious to contribute, as far as may be found practicable, to uphold the interests of His Sardinian Majesty, the Undersigned, one of His Britannic Majesty's Principal Secretaries of State, and the Comte D'Aglié, His Sardinian Majesty's Chargé d'Affaires at this Court, have agreed upon the following Articles, the same being on the part of the Comte D'Aglié sub spe rati: ART. I. A Corps of Piedmontese Prisoners of War, now in Great Britain, shall be assembled and enrolled, under the name of The Royal Piedmontese Legion. II. This Legion shall be composed of the Subjects of His Sardinian Majesty; but if the number of Piedmontese enlisting into the Legion shall not amount to 3000, in that case, Prisoners of War belonging to the North of Italy may be permitted to enlist in it, so as to complete it to the number of 3000. III. The Pay, the Establishment, the Uniform, and in general whatever relates to the formation of The Royal Piedmontese Legion, shall be regulated as much as possible on the scale of the former Piedmontese Army. IV. The British Government engages to provide for the Pay, Clothing, and Maintenance of the Legion, and all which may be necessary, to enable it to take the Field, as well as for the conveyance of the same to the Mediterranean. V. It is understood that the Legion, when completed, shall proceed from a British Port, in the first instance, to the Island of Sardinia; when, if His Sardinian Majesty shall think fit to take the Legion into his service, the Officers and Men shall be disembarked, either there or at any other place of disembarkation to which His Sardinian Majesty shall desire that they shall be conducted: and from the day of disembarkation, the Legion, with Arms, Clothing, and Accoutrements, will be placed at the entire command of His Sardinian Majesty, at whose charge it is to be thenceforward maintained: His Britannic Majesty engaging, in that case, to pay over to the Sardinian Govern ment, at the time of such disembarkation, 3 months' Pay in advance from that day. VI. If the situation of affairs in Europe should not enable His Sardinian Majesty to accept the services of the Legion, as above proposed, it shall continue to serve as an English Foreign Corps, under the command of the Commander in Chief of His Britannic Majesty's Forces in the Mediterranean. VII. The Legion shall be exclusively employed in the Mediterranean, and as much as possible in the way most conducive to the interests of His Sardinian Majesty. VIII. It is understood that His Sardinian Majesty will be entitled, at any time, after reasonable notice, to take the Legion into his service, on the terms specified in Article V; and in that case, the expenses of the transport of the Legion, its pay and maintenance whilst on board, will be borne by His Britannic Majesty. Pero si apareciere que qualquiera de semejantes Embarcaciones represadas há sido em. pleada por el Enemigo, como Buque de Guerra despues de su apresamiento, la tal Embarcacion no será restituida á sus Dueños ó Propietarios, sino que en todos casos, ya sea de Guerra ó ya Particular, el Bastimento que la represe, será declarada legitima Presa en favor de los Apresadores. El presente Convenio será ratificado por las 2 Altas Partes Contratantes, y las Ratificaciones cangeadas en Londres dentro de 6 semanas, ó antes si es posible. En testimonio de lo qual, nos, los Ynfrascriptos Plenipotenciarios hemos firmado, en virtud de nuestros respectivos Plenos Poderes, el presente Convenio, y selladole con los Sellos de nuestras Armas. BATHURST. cases, save as hereafter excepted, be restored to the former Owners or Proprietors, on payment of salvage of 1-eighth part of the true value thereof, if retaken by any Ship of War; and of 1-sixth part, if retaken by any Privateer, or other Ship or Vessel; and in case such Ship or Goods shall have been retaken by the joint operation of one or more Ships of War, and one or more private Ship or Ships, then on payment also of the last-mentioned salvage of 1-sixth part. But if such Ship or Vessel so retaken, shall appear to have been, after the taking by the Enemy, set forth as a Ship or Vessel of War, the said Ship or Vessel shall not be restored to the former Owners or Proprietors, but shall, in all cases, whether retaken by any Ship of War, or by any Privateer or other Vessel, be adjudged lawful Prize for the benefit of the Captors. The present Convention shall be ratified by the 2 High Contracting Parties, and the Ratifications exchanged at London in 6 weeks, or sooner if possible. In witness whereof, we, the Undersigned Plenipotentiaries, have signed, in virtue of our respective Full Powers, the present Convention, and have affixed thereto the Seals of our Arms.
